Social media account or platform
Streaming service
Print or digital publication
Commercial, promotional, or monetized media of any kind
without prior written authorization from Grayson & Mae, LLC is expressly prohibited.
Unauthorized use is subject to a licensing fee of $1,000 USD per day, per platform, per instance of use, billed monthly, beginning on the first date of use.
Monetized Platforms & Advertising-Based NIL Fee
If any website, podcast, broadcast, or social media account generates revenue through advertising, sponsorships, subscriptions, donations, affiliate links, platform revenue-sharing, or any other form of monetization, and uses the name, image, likeness, identity, or protected content of:
Crime and Cask
Crime and Cask Investigations
CC News
CC News Network
James Seidel
James P. Seidel
James Paul Seidel
such use constitutes commercial exploitation, regardless of whether the advertising or sponsorship directly references the above-named entities.
In these circumstances, an additional monetization-based NIL surcharge of $500 USD per day, per platform, will apply, in addition to the standard unauthorized-use licensing fee.
For clarity, monetization includes revenue generated from the platform as a whole, not solely from individual posts, episodes, or publications referencing the protected names or likenesses.
Remedy for Unauthorized Use
For any party that does not wish to participate in a licensing arrangement, the preferred and simplest remedy is:
Immediate removal of all unauthorized uses of protected names, content, image, or likeness.
Continued use after notice constitutes willful and knowing commercial exploitation and will be billed at the applicable daily rates.
Fair Use Clarification
Nothing in this notice restricts lawful commentary, criticism, or reporting about Crime and Cask, CC News Network, or James Seidel.
However, fair use does not extend to:
Commercial exploitation of protected content or identity
Use of names, images, or likenesses to drive traffic or revenue
Brand confusion or false endorsement
Identity-based monetization or audience building
Fair use is a copyright doctrine only and does not supersede trademark rights, right-of-publicity protections, or prohibitions against false affiliation.
Reservation of Rights
Licensing fees and terms are subject to change without written notice.
Grayson & Mae, LLC expressly reserves all rights and remedies, including but not limited to:
DMCA takedown notices
Platform enforcement actions
Trademark and false-endorsement claims
Right-of-publicity and commercial-misappropriation claims
Civil remedies available under state and federal law
Nothing herein shall be construed as a waiver of any rights.
