(Crime and Cask News) In a surprising twist, the defense team for Karen Read, accused of second-degree murder in the death of her boyfriend, Boston Police Officer John O’Keefe, has drawn parallels to the high-profile Alex Murdaugh case as they push for the dismissal of charges. Read’s trial, which ended in a mistrial on July 1, has taken a new turn as her attorneys claim that several jurors had reached a unanimous decision to acquit her before the jury deadlocked.
Since the mistrial, Read’s defense has reportedly been in contact with four jurors who confirmed their decision to acquit her of the most serious charges. Even the prosecution acknowledged receiving similar reports. On these grounds, Read’s attorney, Martin Weinberg, argued that retrying the case would amount to double jeopardy, given the jury’s inclination to acquit.
Weinberg urged the judge to conduct an inquiry, citing the Alex Murdaugh case as a precedent. Murdaugh, a once-prominent attorney, was convicted of murdering his wife and son. However, his defense raised concerns that the jury in his trial had been improperly influenced by comments from the court clerk. Although Murdaugh’s request for a new trial was ultimately denied, the scrutiny of juror interactions in his case has become a focal point in Read’s defense strategy.
Prosecutor Adam Lally strongly opposed the defense’s motion, arguing that there was no formal verdict returned by the jury, and therefore, the defense’s request was not legally permissible. Lally emphasized that the law prohibits the type of inquiry proposed by Weinberg.
Despite the heated arguments, Judge Beverly Cannone stated that she would take the matter under advisement, without providing a timeline for her decision.
