Veteran Prosecutors Join State’s Case; Murdaugh Gets More Time

COLUMBIA, S.C. — Veteran Prosecutors Join State’s Case – The South Carolina Attorney General’s Office has strengthened its legal lineup in the high-profile Alex Murdaugh appeal, adding two seasoned prosecutors to the State’s counsel of record just as the case moves into a critical phase before the state’s highest court.
In an August 13 letter to Supreme Court Clerk Patricia A. Howard, Senior Assistant Deputy Attorney General Mark R. Farthing formally requested that he and Assistant Attorney General Joshua A. Edwards be included on all future correspondence in State v. Richard Alexander Murdaugh. The move places both men alongside Attorney General Alan Wilson, Deputy Attorney General Donald Zelenka, and Senior Assistant Deputy Attorney General Creighton Waters in representing the State.

Farthing is widely regarded as one of South Carolina’s most experienced appellate lawyers, having argued more than 50 cases before the state Supreme Court and over 90 before the Court of Appeals. His work on the Chief Justice’s Committee to Review Appellate Court Rules and his recognition by the South Carolina Bar for trial and appellate advocacy underscore a career built on navigating complex legal disputes. Edwards brings additional prosecutorial depth, with a track record in criminal appeals and trial-level litigation.
What Could This Move by the State Mean?
By adding senior appellate prosecutors like Mark R. Farthing and Joshua A. Edwards strongly suggests the State sees the Murdaugh appeal as a serious, high-stakes fight.
In appellate practice, these kinds of moves aren’t just about filling a slot; they’re a signal. Farthing is a Senior Assistant Deputy Attorney General with experience in complex criminal appeals, and Edwards is a seasoned Assistant Attorney General with a track record in high-profile litigation. Bringing them in midstream shows the AG’s office wants extra firepower, likely because they anticipate aggressive, well-funded arguments from the defense.
That kind of roster upgrade usually means the State is preparing for a prolonged, heavily scrutinized battle — not a routine response.
Murdaugh Granted More Time
The timing of their addition coincides with the court granting Murdaugh’s defense team a 20-day extension to file their reply brief, moving the deadline to September 9, 2025, and authorizing a maximum of 75 pages—though the justices cautioned that this was an outer limit, not an invitation for unnecessary length.

The inclusion of Farthing and Edwards signals the State’s determination to mount a robust defense of Murdaugh’s double murder conviction, a case that has drawn national attention for its explosive allegations of corruption, jury tampering, and prosecutorial overreach. In appellate practice, adding high-caliber attorneys at this stage is often a strategic choice, ensuring that every argument is sharpened and every procedural step meticulously managed.
With the defense poised to counter the State’s 77-page answering brief, the presence of these veteran prosecutors sets the stage for a legal showdown in which both sides will be relying on their most battle-tested advocates. The court’s urging that the reply brief avoid rehashing old arguments suggests the justices expect focused, direct engagement with the State’s claims—an expectation that will test the skill of every lawyer involved.
